Is your physical presence necessary to have a document notarized?

For online notarization, your physical presence in Florida is not necessary but you have to be a US citizen and confirm that you desire for the notarial act to be performed by a Florida notary public and under the general law of this state.

Is remote online notarization (RON) compatible with Florida law?

Yes, on June 7, 2019, HB 409 “Electronic Legal Documents” was signed into law. This law is in effect as of January 1, 2020. Florida law allows online notarization when certain conditions are met.

Can any notary public notarize my signature online?

No, only a notary public licensed to perform RON (Remote Online Notary), and who has received appropriate training can perform online notarization over the internet. Every RON notary public can notarize in person, but not every regular notary public can notarize via internet. 

How does remote online notary public (RON) verify my identity via internet?

The RON online notary uses special internet software that has the identity of the person checking the authenticity of the document presented, comparing the photo taken with a webcam with the photo on the identity and asking a number of questions to which the person must answer correctly. Due to confirmation of identity, a person who has a signature confirmation via the Internet must have a social security number, as it is not possible to access websites confirming identity.

Can remote online notary public (RON) confirm a signature based on personal knowledge?

Yes. If RON notary public knows someone personally, they can confirm that person’s identity without checking a document based on personal knowledge.

Do I have to be in Florida for a Florida online notary public (RON) to notarize my signature online?

No. The person, whose signature is notarized via the internet may be outside Florida during internet connection with the notary.

Do I have to be a Florida resident to be able to use services of a Florida online notary public (RON)?

No. A person wishing to use services of a Florida online notary public does not have to be a Florida resident, but must confirm confirm his or her desire for the notarial act to be performed by a Florida notary public and under the general law of this state.

What technical requirements must my computer meet for online notarization of my signature over the internet?

A person who wants to have their signature notarized online must have a computer with internet access, a microphone and a webcam.
